1. Wuhan Tianjin Technology Co., Ltd. (hereinafter referred to as 'Tianjin') promises to comply with any applicable export control and trade sanctions laws and regulations, including but not limited to the US Export Administration Regulations ('EAR'), the International Arms Trade Regulations, and other relevant national and regional export control and trade sanctions laws and regulations.
2. Tianjin confirms and agrees that the export, re export, and (domestic) transfer of products, technology, or software (hereinafter collectively referred to as 'Contract Items') shall comply with any applicable export control and trade sanctions laws and regulations.
3. In particular, in order to comply with US export control and trade sanctions laws and regulations, Tianjin guarantees that it will not directly or indirectly sell or provide controlled products in any other way to the following countries/regions or individuals: (i) countries or regions that are subject to comprehensive US sanctions, including Cuba, Iran, North Korea, Syria, Ukraine, Crimea Specific regions of Ukraine (including the so-called Donetsk People's Republic and Luhansk People's Republic); (ii) Entities or individuals included in the US Department of Commerce's 'Entity List', 'Denied Persons List', and other US export control and trade sanctions blacklists.
4. Tianjin further promises that the regulated products will not be used for the following prohibited purposes: (i) biological weapons: for the design, development, production, or use of chemical or biological weapons and their delivery systems; (ii) Rocket systems: used for designing, developing, producing, or using rocket systems, including but not limited to ballistic missiles, space launch vehicles, and sounding rockets; (iii) Unmanned aerial vehicles: used for the design, development, production, or use of unmanned aerial vehicles, including but not limited to cruise missile systems, target drones, and reconnaissance drones; (iv) Nuclear use: used for nuclear purposes, including but not limited to nuclear explosion activities, unsecured nuclear fuel cycles, or other nuclear activities; (v) Marine nuclear power: used for the design, development, production, construction, support or maintenance of marine nuclear power projects; (vi) Terrorism: used for terrorist purposes.
5. Tianjin further promises that its regulated products will not be resold, transferred, or provided in any other way to military end-users or used for military purposes. Military end-users refer to any entity or individual of a country's armed forces (army, navy, marine corps, air force or coast guard), national guard, national police, government intelligence and reconnaissance organization, or their actions or functions aimed at supporting military end-use. Military end use refers to the incorporation of (an item) into: (i) the U.S. Munitions List (see 22 CFR Part 121, International Arms Trade Regulations) or the Wassenaar Arrangement Munitions List (see Wassenaar Arrangement Munitions List, see Wassenaar Arrangement website) http://www.wassenaar.org )Listed military products; (ii) Export Control Classification Number (ECCN) for items ending in 'A018' or '600 series'; Or (iii) any item designed for use in the military items listed on the US Munitions List or the Wassenaar Arrangement Munitions List, or for 'use' (including operation, installation, maintenance, repair, overhaul, refurbishment), 'development,' 'production,' or deployment of ECCN items ending in 'A018' or for '600 series' items.
6. Tianjin represents and warrants that: (i) Tianjin and its agents, directors, executives, and employees have not been included in the following sanctions lists: the United Nations Security Council sanctions list, the EU financial sanctions list, the US special designated nationals and frozen persons list, entity list, rejected persons list, unverified list, military end-user list, industry sanctions list, and overseas evaders list, And any sanctions list administered by any country or government with jurisdiction over either party to the contract or the performance of the contract; Tianjin is not directly or indirectly controlled by, or acting on behalf of, individuals listed on the EU's financial sanctions list, the US's specially designated nationals, and frozen persons list who hold a cumulative shareholding of more than 50%.
